The Chairperson of Parliament’s Ad Hoc Committee, Soviet Lekganyane and National Assembly Speaker Thoko Didiza, are expected to sign the envisaged summons, to be issued to private investigator Paul O’Sullivan.
This is if O’Sullivan fails to comply with the committee’s invitation. Last week O’Sullivan walked out of the committee, leaving MPs stunned.
The committee has resolved to seek a legal opinion on the matter before taking further action against him.
Andile Tetyana from Parliament’s legal services briefed the committee on the way forward.
“All I can say is that the Speaker has the issuing authority in far as the summoning procedure is concerned. She is briefed in this regard. The Speaker has indicated that she is at the service of the committee and will act as soon as she is formally briefed about what the committee has resolved in this regard. Chairperson to this end I can also confirm that a request for concurrence has been prepared for signature by both the chairperson of the committee and the Speaker should Mr O’Sullivan not comply with the committee’s invitation,” says Tetyana.

A legal opinion from Parliament’s legal services unit indicates that private investigator Paul O’Sullivan has flouted both the rules of Parliament, as well as the terms of reference of the Ad Hoc Committee.
Last week O’Sullivan left committee members stunned when he walked out of the proceedings saying he was rushing to catch a flight.
One of the legal services unit advisors at Parliament, Telena Halley-Starkey, elaborates.
“In leaving the proceedings pre-maturely Mr O’Sullivan’s actions may reasonable be constrained as reasonable as impeding or interfering with the work of the committee in the execution of its mandate. Honorable members the committee’s terms of reference require it to assess the veracity of the allegations advance by various witnesses including that of Mr O’Sullivan whose evidence was material particularly in relation to allegations of political interference in police operations. His departure before completing the examinations before the committee interfered with the committee’s ability to discharged it functions in terms of its terms of reference.”
