Justice and Constitutional Development Minister Mmamoloko Kubayi says over the past 30 years, the South African Constitution has delivered on many of its promises including the integration of the judicial system.
Kubayi delivered the keynote address at the national launch of the 30-year anniversary of the Constitution’s signing into law at the Apartheid Museum in Johannesburg.
Kubayi says while challenges remain, the work of transformation must continue.
“These developments are significant because access to justice is a substantial and substantive constitutional obligation. One that extends beyond the mere existence…to encompass whether those courts are practically accessible, procedurally comprehensive, and institutionally equipped to serve those who have historically be furthered from them. If the justice system provides one category of proof, the advancement of human rights provides another. And it is here that the Constitutional, the Constitution’s responsiveness is perhaps most vividly demonstrated. And the nap of the constitutional dispensation lies the bill of rights, chapter 2. Does something ambitious, that 30 years on still deserves appreciation.”
